Having previously represented the Missouri Public Service Commission (PSC), attorney Douglas Healy and his firm successfully represented Invenergy in a recent appeals case involving the Grain Belt Express transmission line. In December 2019, the Missouri Court of Appeals, Eastern District, ruled that Missourians stand to benefit from the Grain Belt project. This ruling came after landowners and the Missouri Farm Bureau appealed the PSC’s original decision that the project was in the public’s interest, thus allowing it to run power lines across private property. Overseen by Invenergy, a Chicago-based company, the Grain Belt project will share wind-generating energy to Missouri and into several Eastern States. This energy will come from Kansas. By sharing this energy, customers of the Missouri Joint Municipal Electric Utility Commission will save an estimated $9.5 million to $11 million annually. Further, the organization will get up to 250 MW of capacity, thanks to the project. However, arguments against the project noted that the transmission line is not a public utility, despite the fact that it will benefit Missourians. Due to this classification, the assumption is that the project should not have eminent domain over property in the state.
